CHAPTER-ONE - Legal Terms

• CHAPTER-ONE is an online platform that allows users to generate ebooks, audiobooks and illustrations using AI technology, and to sell generated ebooks and audiobooks through an internal marketplace.

• The service is currently operated by a private individual based in Poland. In the event of establishing a registered business, the operator details will be updated accordingly.

• Creating an account is required to use the Service.

• Users must provide accurate and truthful information.

• Each user is responsible for all activities performed on their account.

• Sharing accounts with third parties is prohibited.

• CHAPTER-ONE offers time-limited subscriptions valid for 30 days.

• Subscriptions do NOT renew automatically.

• Each subscription must be manually purchased again after expiration.

• Subscriptions are paid in advance.

• No refunds are available once a subscription has been purchased, regardless of usage.

• Tokens are virtual digital units used to generate text, audio and illustrations.

• Monthly Tokens (granted with a subscription):

• expire 30 days after being granted,

• are non-refundable,

• cannot be exchanged for money.

• Extra Tokens (purchased separately):

• do not expire,

• are non-refundable,

• cannot be exchanged for money.

• Ebook and audiobook purchases are final.

• Digital products are non-refundable and non-returnable.

• Users may sell generated ebooks and audiobooks through the CHAPTER-ONE marketplace.

• The creator receives 60% of the sale price.

• Payouts are:

• processed only via PayPal,

• subject to a minimum payout of 50 USD,

• manually reviewed and approved by the platform administrator,

• processed within several business days.

• Users are solely responsible for declaring and paying all applicable taxes.

• CHAPTER-ONE uses third-party AI models, including the OpenAI API, to generate content.

• Users must comply with:

• these Terms,

• applicable laws,

• current OpenAI policies, which are considered binding and overriding.

• OpenAI policies may change at any time without notice. Users are responsible for staying up to date.

• Allowed content includes, but is not limited to:

• fictional and creative writing,

• novels, crime stories, thrillers, fantasy, science fiction,

• war and historical narratives,

• non-graphic, non-fetishized narrative violence,

• limited adult themes permitted under OpenAI rules.

• The generation of the following content is strictly prohibited:

• pornographic or explicit sexual content,

• sexual content involving minors,

• graphic, realistic, extreme or fetishized violence,

• hate speech, discrimination, terrorism or criminal facilitation,

• illegal content or content infringing third-party rights,

• attempts to bypass AI safeguards.

• The platform may:

• filter or block prompts,

• modify or refuse content generation,

• remove generated content,

• suspend or permanently terminate accounts,

• block payouts and stored balances (temporarily or permanently).

• Decisions made by the platform administrator are final.

• All services and products offered by CHAPTER-ONE are digital in nature.

• Under applicable consumer law, users waive their right of withdrawal once digital service delivery begins.

• No refunds are provided for:

• subscriptions,

• tokens,

• ebooks,

• audiobooks.

• Exceptions may be considered only in cases of:

• permanent service unavailability,

• incorrect billing.

• The platform collects only the minimum required data:

• email address (required),

• username (required),

• full name (optional),

• artistic pseudonym (optional),

• PayPal email (required only for payouts).

• No payment card data is stored.

• Personal data is processed for:

• account management,

• payments and payouts,

• service security,

• legal compliance.

• Payments are handled by Stripe (subscriptions and tokens) and PayPal (payouts).

• Due to the global nature of the service, data may be processed outside the EU in compliance with GDPR safeguards.

• The platform operator reserves the right to modify these terms at any time.

• Changes take effect upon publication.

• Continued use of the service constitutes acceptance of the updated terms.
